Baden-Baden Regional Court issues temporary injunction against Google Fonts warning letter Martin Ismail
The topic of Google Fonts warnings is currently on everyone’s lips. In our case, it is about the Google Fonts warnings from Kilian Lenard for Martin Ismail. However, others are also circulating, e.g. from Wang Yu by RAAG and Loris Bachert.

There is a way to oppose the current wave of warning letters. We did this for a client and last week obtained a temporary injunction against Martin Ismail from the Baden-Baden Regional Court. In other words, against the person in whose name the warnings regarding ‘infringement of personal rights data protection Google Fonts’ are being issued and sent out on a regular basis.
In any case, in the constellation in question, the Regional Court of Baden-Baden affirmed our claim for injunctive relief based on interference and the established and exercised commercial operation. Mr Ismail is therefore prohibited (from the date of service of the interim injunction) from contacting one of our client’s partner companies in connection with the integration of ‘Google Fonts’.
Violation of the ban may result in a fine of up to € 250,000 or even imprisonment (LG Baden-Baden, Beschluss v. 11.10.2022, Az. 3 O 277/22, available here as PDF).
For the sake of good order, it should be noted that the order is currently still being served and the court has issued the order without hearing the other party. It is therefore currently neither final nor legally binding. The naming of the defendant is permissible here without further ado due to the public interest in his person.

We are currently receiving numerous enquiries about Google Fonts warnings and the injunction we obtained in this regard before the Baden-Baden Regional Court. The main concern of those affected is to find out how best to react.

Many people have read the news about the injunction we obtained against ‘Martin Ismail’ at Baden-Baden District Court with interest. Many thanks for the feedback and response. Our telephones have not stopped ringing since then and our e-mail inboxes are overflowing. We will of course continue to endeavour to answer all enquiries.
In the meantime, there is news in the preliminary injunction proceedings. After the injunction was served, ‘IG Datenschutz’ and the people behind the ‘community of interests’ made a detailed but partly untrue statement on their website.
